Recent Litigation Achievements:

In the matter of "Doe" v. Fidelity," one of Geraci Law Firm's trial litigator  successful settled this case in a confidential settlement  agreement.  Fidelity paid our client "Doe," almost 200,000 for settlement of a bad faith suit instead of proceeding with a trial for this case.

Partners of Geraci Law Firm, Christina L. Geraci, Esq. and Anthony F. Geraci, Esq. helped US Bank close on a multimillion dollar loan with Sinclair Paint cross-collateralized with two commercial structures.

An 88 year old lady was defrauded by her fiduciary and retained Geraci Law Firm to sue her fiduciary.  Geraci Law Firm tried this case before a jury trial for three weeks to represented the 88 year old plaintiff and successfully obtained a Jury Verdict for Fraud and Breach of Fiduciary Duty.  The Jury Verdict awarded the plaintiff $235,000 in actual/punitive damages and $117,000 in attorney's fees.

Litigation Achievements:

Obtained dismissal with prejudice of all federal claims filed against lender, lender's assignee and trustee of various federal claims asserted against the parties in connection with a hard money secured loan.

After defeating a motion for preliminary injunction which attempted to stop a foreclosure sale, and after the sale had been completed, the firm obtained an order granting its demurrer as to all causes of action on plaintiff's complaint for various post-foreclosure causes of action arising out of a hard money loan.

Successfully defeated a Preliminary Injunction of an owner occupied residence at no cost to the lender.      

Successfully defended employer against employee, who was in-house counsel for employer, where employee claimed right to indemnification for legal malpractice and Breach of Contract Damages.  Geraci Law Firm settled the case for a small fraction of the requested damages. 

Successfully defended mortgage lenders in bankruptcy court against borrowers who attempt to strip junior liens and cram down liens on real property.

April 2010 - Geraci Law Firm Attorneys, Christina L. Geraci and Amy E. Martinez, attended the North Los Angeles Chapter Meeting of the California Credit Union Collector's Council (the "CCUCC").  The Geraci Law Firm actively participates in several chapters of the "CCUCC" and works with credit unions and other lenders to recover against defaulting borrowers.  Geraci Law Firm can assist lenders with litigation, judicial foreclosures, deficiency judgments, collections, asset location and recovery, and any other steps necessary to obtain or enforce a judgment.  Additionally, Geraci Law Firm was the lead sponsor of the 2010 CCUCC Annual Conference in Anaheim and will be participating in the 2011 Conference in Palm Springs.  

March 2010. Geraci Law Firm welcomes Anthony (Tony) Patel to their team! Tony Patel is a corporate attorney with a strong background in business, finance and technology.  His past experience includes work in securities transactions (including public and private offerings), complex mergers and acquisitions, venture capital, broker-dealers, investment funds, corporate governance, workouts, restructuring, and general commercial transactions.  Mr. Patel also has substantial experience working with technology companies across a variety of sectors, including Internet, digital media, software, services, semiconductors, life sciences and biotechnology.

July 1, 2009.  Anthony F. Geraci  and Geraci Law Firm have accepted the role of corporate counsel to and a director of the National Hard Money Association (“NHMA”).  The NHMA's mission is to foster and promote the growth of the industry and to serve its members is offered to hard money lenders, individual note and mortgage pool investors, and providers of goods and services to the industry as a whole. Asked about the NHMA, Mr. Geraci stated that "the NHMA will fill a much needed role as a national presence for hard money and private money lenders.  Hard money lenders and private money lenders currently have no steady voice in Washington, D.C. as it relates to how laws nationally will affect them.  With the NHMA, they will now have that voice."  NHMA plans to have their West Coast Conference on November 18-20, 2009 in Caesar's Palace, Las Vegas, Nevada.  For more information, please go to http://www.nhmaonline.com.
